This document describes the Terms of Use of Vastukul Website and Services. You should also review our Privacy Policy, which describes our practices regarding information handling in detail. The text in the boxes is for information purposes only and should not be substituted for a legal document.

Vastukul (“Vastukul”, “us”, “we”, or “our”) offers products and services provided by EDINOEX PVT. LTD. only and operates through www.vastukul.org. We are an interactive ed-tech platform serving globally. As of now, we don’t have any subsidiaries or branches by any other name. These Terms of Use (“Terms” or “Conditions”) govern the use of our website, the content, and the products and services (“Services”) nested herein.

Please read these Terms of Use carefully before using the website. By accessing and/or using the website (other than to read these Terms for the first time or before subscribing to any of our Services) you are agreeing to comply with these Terms, which may change from time to time. These Terms require you to agree to arbitrate disputes rather than going to court, grant us certain rights and licenses, provide us certain indemnities, waive certain of your rights and remedies, and limit our liability and obligations to you. Do not use the site or purchase our products or services if you do not agree. Please read these terms carefully, and contact us if you have any questions prior to using the website and/or services.

We will send out a notification in public interest anytime our Terms are modified or updated. Please make sure you read through the notifications. We would automatically consider your consent until you explicitly withdraw your consent by de-activating/deleting your account. Any activity prior to the withdrawal is bound by these Terms of Use, Code of Conduct, Honor Code, and our Privacy Policy.

Acceptance of Terms

Before you start using Vastukul website and any linked pages or content (“Site”), you are required to read, understand, and agree to these Terms of Use. We intend to inform you that these Terms are designed to support both our users and content creators in preserving their rights to use the content available on our platform, and safeguard from unlawful activities. Agreeing to these Terms is a receipt that you hereby acknowledge the sufficiency of these Terms and Conditions, and have fully reviewed them. In addition to these Terms, Vastukul has established a Privacy Policy outlining how we utilise the user information collected and used by Vastukul. A copy of our complete Privacy Policy can be viewed here and is also incorporated in our Terms of Use. By accessing Vastukul website, resources, or services, you are signifying your acknowledgement and agreement to Vastukul’s Privacy Policies.

If you do not agree to be bound by the terms of this Agreement as detailed herein, please do not use or access the website. If you are a registered user, please de-activate/delete your account if you no longer agree to be bound by these Terms, and forfeit the access to our content. In addition, you represent that you are at least 18 years old and legally competent to enter into this agreement. By using our Services, you agree to be bound by these Terms, including the policies referenced in these Terms.

THESE TERMS INCLUDE AN ARBITRATION AGREEMENT THAT APPLIES TO ALL CLAIMS BROUGHT AGAINST VASTUKUL. PLEASE READ THEM CAREFULLY; THEY AFFECT YOUR LEGAL RIGHTS.

Modification to Terminating our Services

We are constantly improving our services and strive to deliver you only the best. Vastukul reserves the right, at its sole discretion, to modify or replace any part of these Terms. A public interest notice will be issued anytime our Terms are modified or updated, however, it is your responsibility to check and read these Terms to keep yourself updated on the changes. Vastukul may, in future, offer new services through its website or online presence. Such new features or services will be subject to the same terms and conditions as expressed in these Terms. We also reserve the right to add or remove functions, features, or requirements, and we may suspend or stop part of our Services altogether.

Accordingly, Vastukul reserves the right to terminate your use of Service(s). If a paid Service is terminated, a refund may be available under our Refund Policy. You may be notified of the reason through email registered with Vastukul prior to (or at the time of) suspension or termination of your access to Services in certain cases.

We may not be able to deliver the Services to certain regions or countries for various reasons, including due to applicable export control requirements or internet access limitations and restrictions from governments. Vastukul, its Content Providers and instructors, its contributors, sponsors, and other business partners and their employees (the “Vastukul Parties”) shall have any liability to you for any such action. You can stop using our Services at any time, although we’ll be sorry to see you go.

Using Vastukul

Your access to our site may be interrupted from time to time as a result of routine update, maintenance, repair, equipment malfunction, or any other reason within or outside the control of Vastukul. Vastukul reserves the right to suspend or discontinue the availability of the Site and/or any Services and/or remove any Content at any time at its sole discretion without any prior notice. Vastukul may impose limits on certain features and Services or restrict your access to parts of or all of the Site and Services, at its sole discretion, without notice or liability. You are entitled to request a reason for restricted access and/or termination through our Contact Us page.

Vastukul website or platform should not be relied upon for storage of your data, images, photographs, videos, or content of any kind you uploaded. You are hereby notified to be responsible to retain your own copies of all Content posted on your website.  

• Who may use our services

You may use our services only if you are in a binding contract with Vastukul, governed by these Terms and all applicable laws. You agree to provide us with accurate and complete information when you create a Vastukul account; or subscribe to any Vastukul Services as bound by these Terms. You also agree to update your information to keep it accurate and complete at all times. Vastukul is not liable in case any notices or communication do not reach you due to missing or outdated contact information. Any use or access by anyone under the age of 13 is prohibited, and certain regions and Content Offerings may have additional requirements and/or restrictions.

• Website access and use

Access to Vastukul website including, without limitation, the Content and all Services is provided to you for educational and personal (strictly non-commercial) use only. As per these Terms, you may not use, reproduce, distribute, create derivative works based upon, publicly display, publicly perform, publish, transmit, or otherwise exploit Website Content for any purpose whatsoever without obtaining prior written consent from us.

By agreeing to these Terms, you consent to comply with all applicable laws including Indian Copyright Act. You also agree to cooperate fully with Vastukul to investigate any suspected or actual activity that is in breach of these Terms. Furthermore, except as expressly permitted in these Terms, you may not:

1. Circumvent, disable or otherwise interfere with security-related features of the Website including, without limitation, any features that prevent or restrict use or copying of any content or enforce limitations on the use of the Website or Website Content;
2. Use an automatic device (such as a robot or spider) or manual process to copy or “scrape” the Website or Website Content for any purpose. Notwithstanding the foregoing, Vastukul grants public search engine operators permission to use automatic devices (such as robots or spiders) to copy Website Content from the Website for the sole purpose of creating (and only to the extent necessary to create) a searchable index of Website Content that is available to the public. We reserve the right to revoke this permission (generally or specifically) at any time.
3. Attempt to or interfere with the proper working of the Website or impair, overburden, or disable the same; decompile, reverse engineer, or disassemble any portion of any the Website;
4. Use network-monitoring software to determine architecture of or extract usage data from the Website;
5. Encourage conduct that violates any local, state or federal law, either civil or criminal, or impersonate another user, person, or entity.
6. Engage in any conduct that restricts or inhibits any other user from using or enjoying the Website.

• Our License extended to you

Subject to these Terms, and our policies (including Acceptable Use Policy, Code of Conduct, Privacy Policy, Honor Code, course-specific eligibility requirements, and other applicable Terms), we grant you a limited, personal, non-exclusive, non-transferable, and revocable license to use our Services and any other packages offer through our Website. You may download content from our Services only for your personal, non-commercial use, unless you obtain our written permission to otherwise use the content. 

You understand and agree you have no right to modify, edit, create derivative works from, distribute, sell, rent, share, or republish any Site information or Packages or Service materials without our express consent. You also agree that you will create, access, and/or use only one user account and you will not share access to your account or access information for your account with any third party. Using our Services does not give you ownership of or any intellectual property rights in our Services or the content you access. The right to ownership is reserved for Vastukul and affiliated creators governed by a written contract endorsed by all parties involved.

Description of Site

Vastukul website is an online community dedicated to Architecture, Planning, Design and allied fields. Vastukul offers an open and accessible platform for professionals to connect, collaborate, and contribute through its forum; ideate and participate in skill development through its courses; educate and elevate through its blogs and newsletters; and find employment through its job board.

The Site enables the users to post images and videos, share comments, opinions and ideas, promote their work, participate in contests and promotions, and access and/or purchase services from time to time made available on the Site (“Services”). Services include, but are not limited to, any service and/or content Vastukul makes available to or performs for you, as well as the offering of any materials displayed, transmitted or performed on the Site or through the Services. Content (“Content”) includes, but is not limited to text, user comments, messages, information, data, graphics, news articles, photographs, videos, sounds, images, illustrations, and ebooks.

Intellectual Property

The Site and any trademarks, logo, all text, illustrations, files, images,script, graphics, ebooks, photos, sounds, music, videos, information, materials, products, services, URLs, technology, documentation, and interactive features, and other content and assets (collectively “Vastukul Materials”) that Vastukul provides to you as part of the Services are protected by intellectual property rights. Vastukul Materials and all Intellectual property rights to Vastukul Materials are owned by us, our licensors, collaborators, or a combination of said parties.

Using our Site does not give you ownership of any such intellectual property rights. You may not use content accessible from our Site unless you obtain prior permission from its owner or are otherwise permitted by law. You are not permitted to use Vastukul’s trademark and logos related to any and all Services without our explicit prior consent. Do not remove, obscure, or alter ant text, proprietary notices, and/or graphics contained in the Vastukul Materials. You cannot use Vastukul Materials to construct any kind of database, including for personal, non-commercial uses. Any rights not expressly granted in these Terms are expressly reserved.

Content Offering

At present, Vastukul is in no way affiliated with or endorsed by any state, national, or professional licensing board, group, or institution. Any reference to such entities is undertaken on a fair use basis.

• Changes to the Content

Vastukul offers courses and content (“Content Offerings”) from educators, professionals and other providers (“Content Providers”). While we seek to provide world-class Content Offerings from our Content Providers, unexpected events do occur. Vastukul reserves the right to cancel, interrupt, reschedule, or modify any Content Offerings, or change the point value or weight of any assignment, quiz, or other assessment, either solely, or in accordance with Content Provider instructions. Content Offerings are subject to the Disclaimers and Limitation of Liability sections below.

• No Academic Credit

Unless otherwise explicitly indicated by a credit-granting institution, participation in or completion of Content Offerings does not confer any academic credit. Vastukul, instructors, and the associated Content Providers have no obligation to have Content Offerings recognized by any educational institution or accreditation organization.

• Student-Content Provider Relationship

Nothing in these Terms or otherwise with respect to your participation in any Content Offerings by Content Providers : (a) establishes any relationship between you and any Content Provider; (b) enrolls or registers you in any Content Provider institution, or in any Content Offering offered by any Content Provider institution; or (c) entitles you to use the resources of any Content Provider institution beyond participation in the Content Offering.

Policy Surrounding Your Content

The Services enable you to share your content, such as homework, quizzes, projects, other assignments you submit, posts you make in the forums, and the like (“User Content”), with Coursera, instructors, and/or other users. You retain all intellectual property rights in, and are responsible for, the User Content you create and share. User Content does not include course content or other materials (including ebooks) made available on or placed on to the Vastukul platform by or on behalf of Content Providers or their instructors using the Services or Content Offerings. As between Vastukul and Content Providers, such Content Offerings are governed by the relevant agreements in place between Vastukul and Content Providers.

• Personal Data we collect

While using our Service, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you (“Personal Data”). Personally identifiable information may include, but is not limited to:

1. First name and last name
2. Email address
3. Address, State, Province, ZIP/Postal code, City

We may use your Personal Data to contact you with newsletters, marketing or promotional materials and other information that may be of interest to you. You may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or instructions provided in any email we send.

We may also collect information on how the Service is accessed and used (“Usage Data”). This Usage Data may include information such as your computer’s Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Service that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data.

• How we may use collected data

You agree that to the extent that you provide us with User Content, you grant Vastukul a fully-transferable, royalty-free, perpetual, sublicensable, non-exclusive, worldwide license to copy, distribute, modify, create derivative works based on, publicly display and perform, and otherwise use the User Content. This license grants Vastukul the right to authorize Content Providers with their registered Users, on-campus learners, or other learners independent of their affiliations. Nothing in these terms shall restrict other legal rights Vastukul may have to User Content, for example, under other Licenses. We reserve the right to remove or modify User Content for any other reason not listed here, including User Content that violates these Terms or other policies referenced in these Terms, including our Acceptable Use Policy and Code of Conduct.

We may use a combination of identifying or non-identifying information to:

• provide and maintain our Services,
• notify you about the changes to our Services,
• allow you to participate in interactive features when you choose to do so,
• understand who our visitors are,
• provide customer care and support,
• monitor usage of our Services,
• detect errors and prevent foul play and technical issues, and
• understand how we may improve their experience of our Services in future. 

It is strictly for organizational, administrative, and internal reasons, and we assure to not disclose the specifics of this information publicly.

• Transfer of Data

Your information, including Personal Data, may be transferred to — and maintained on — computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ from those in your jurisdiction.

If you are located outside India and choose to provide information to us, please note that we transfer the data, including Personal Data, to India and process it there. Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.

• Security

The security of your data is important to us, but remember that no method of transmission over the internet, or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security.

We care about the security of our users. While we work to protect the security of your account and related information, Vastukul cannot guarantee that unauthorized third parties will not be able to defeat our security measures. Please notify us immediately of any compromise or unauthorized use of your account by emailing Contact@vastukul.org. 

• Termination

Vastukul may terminate your access to all or any part of the Site at any time, with or without cause, with or without notice, effective immediately.

You can stop using our Services at any time. You may delete your account by going to your account settings. When you delete your account, we will delete your profile and all related data including your projects, favorites and comments in other projects in the Site, although this may not take place immediately. Vastukul cannot delete your forum topics and responses, unless explicitly requested. We may, in future, adopt a protocol to disassociate your profile from all the activity after deletion of your profile. In case of disassociation, we are not able to delete or remove your comments.

• Feedback

We welcome your suggestions, ideas, comments, and other feedback regarding the Services (“Feedback”). By submitting any Feedback, you grant us the right to use the Feedback without any restriction or any compensation to you. By accepting your Feedback, Vastukul does not waive any rights to use similar or related Feedback previously known to Vastukul, developed by Vastukul Parties or obtained from any other source.

Registration

You may need to create an account with Vastukul in order to use some of our Services. For that purpose, you will be required to select a password and username, and to provide registration information. The registration information you provide must be accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

You may not use as a username – the name of another person or entity or that is not lawfully available for use, a name or a trademark that is subject to any rights of another person or entity other than you without appropriate authorization, or a name that in a manner misleads the readers into thinking that you are another person or company, or a name that is otherwise offensive, vulgar or obscene.

It is your responsibility to keep your login credentials secure and you are solely responsible for all activities that occur via your account. You must immediately notify Vastukul of any unauthorized uses of your account or any other breaches of contact@vastukul.org. Vastukul will not be liable for any acts or omissions by you, including any damages of any kind incurred as a result of such acts or omissions.

If you are using our Services on behalf of a business, that business accepts these terms.

You must be a human to open an account. Accounts registered by “bots” or other automated methods are not permitted.

Pages describing the Services are accessible from around the world but this does not mean all Services or service features are available in your country, or that user-generated Content available via the Services is legal in your country. Vastukul may block access to certain Services (or certain service features or Content) in certain countries. It is your responsibility to make sure your use of the Services is legal in the country where you live. Services are not available in all languages.

User Conduct

If you operate an account, comment on a forum or project, post material on the Site, post links on the Site, or otherwise make (or allow any third party to make) material available by means of the Site, you are entirely responsible for the content of, and any harm resulting from, that Content. That is the case regardless of the type of Content (e.g., images, video, sound, links, etc.). Vastukul does not control user submitted Content and, as such, we do not guarantee the accuracy, integrity or quality of such Content. You understand that by using this Site you may be exposed to Content that is offensive, indecent or objectionable.

As a condition of use, you promise no to use the Services for any purpose that is unlawful or prohibited by these Terms, or any other purpose not reasonably intended by Vastukul. Please refer to our Acceptable Use Policy, Code of Conduct, and Honor Code for a comprehensive understanding of User Conduct.

Teaching and Attending a Class

Vastukul provides a community to learn from educators, professionals, and experts through online classes (“Classes”).

These Terms, the Privacy Policy and any other legal notices published by Vastukul are in addition to any agreements, releases or other documents (the “Class Agreements”) that a teacher and student may enter into in connection with a class, including any Class Agreements entered into through the Site. Students and teachers are each responsible to the other for complying with the terms of the Class Agreements, but Vastukul has no control over either party’s compliance. Among other things, Vastukul cannot control:

(a) the provisions of the Class Agreements, 

(b) the accuracy or legality of the Class Agreements or 

(c) any party’s performance of its obligations under the Class Agreements. 

Accordingly, Vastukul shall not be held responsible for any liability arising out of the Class Agreements or any actions that you may take in reliance thereon, and is not a party to any transaction between you and any other user. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU HEREBY RELEASE VASTUKUL AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES AND THEIR RESPECTIVE SUCCESSORS AND ASSIGNS (COLLECTIVELY, THE “VASTUKUL PARTIES”) FROM ANY CLAIMS OR DAMAGES OF ANY KIND OR NATURE, KNOWN OR UNKNOWN, SUSPECTED OR UNSUSPECTED, DISCLOSED OR UNDISCLOSED, RELATING TO ANY DISPUTE RELATING TO THE CLASS AGREEMENTS OR ANY TRANSACTION OR ATTEMPTED TRANSACTION WITH ANOTHER USER OF THE SERVICE (WHETHER A STUDENT OR TEACHER). YOU AGREE AND UNDERSTAND AND INTEND THAT THIS ASSUMPTION OF RISK AND RELEASE IS BINDING UPON YOU AND YOUR HEIRS, EXECUTORS, AGENTS, ADMINISTRATORS AND ASSIGNS.

You expressly acknowledge and agree that your use of the Site, the Classes and all Content and services available on the Site is at your sole risk and responsibility. THE CLASSES (INCLUDING ANY CONTENT) ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITH NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. YOU ASSUME TOTAL RESPONSIBILITY AND THE ENTIRE RISK FOR YOUR USE OF THE ONLINE COURSES AND CONTENT.

WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT:

(A) THE CONTENT OR THE CLASSES WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS OR ACHIEVE THE INTENDED PURPOSES, 

(B) THE CLASSES WILL NOT EXPERIENCE OUTAGES OR OTHERWISE BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE,

(C) THE INFORMATION OR CONTENT OBTAINED THROUGH THE CLASSES, SUCH AS CHAT ROOM SERVICES, WILL BE ACCURATE, COMPLETE, CURRENT, ERROR-FREE, COMPLETELY SECURE OR RELIABLE, OR 

(D) THAT DEFECTS ON THE CONTENT WILL BE CORRECTED. YOU ASSUME ALL RISK OF PERSONAL INJURY, INCLUDING DEATH AND DAMAGE TO PERSONAL PROPERTY, SUSTAINED FROM USE OF THE CLASSES AND CONTENT.

Vastukul reserves the right to, but is under no obligation, to delete the listing of any class at any time and for any reason.

Rules for Teachers

By listing a class on Vastukul, you assume full responsibility for the content of the service offered. You also understand that it is publicly available to be viewed and book by any student.

By listing a class on Vastukul, you agree to honor all registrations at the price and time listed in the Site, and not to refuse registration or attendance by any student for any discriminatory or other illegal reason.

You represent and warrant to Vastukul that you are qualified to teach the classes that you list with the Site and that you will at all times conduct yourself in a professional manner and in compliance with all applicable laws.

You agree not to abuse your students’ personal information. Abuse is defined as using personal information for any purpose other than those explicitly specified in your class without the students’ prior consent.

You understand that, if you teach a class, your students will have the opportunity to review their experience with you. We cannot control the contents of any such review and will not be held responsible for any information or opinions that a user may include in any such review.

You may choose to remove content from your class and will continue to own such content, but we will continue to have the right to use that content and to provide it to students who have paid for your class.

You understand and acknowledge that Vastukul will have the right to refuse your services as a teacher, with or without reason. You also understand that Vastukul will have the right to decide the subject of the class and its content and scope.

You have read, understand and agree to the Class Guidelines and the Eligibility Requirements. You also understand and agree that we will not pay you for any expenses in which you may have incurred in the preparation of a class that does not pass our approval process.

Rules for Students

You agree to accept all of the Terms and conditions including the cancellation policy listed in the Site when you agree to book a class on Vastukul. All Classes offered on Vastukul are valid only for the specified dates (if mentioned in the listing, otherwise the classes are available to the registered learner indefinitely).

You agree to follow all reasonable rules set by a teacher with respect to a Class, and not to take any actions to interfere with the teacher or any other students in the Class.

When you pay to participate in the Class you will have the right to download the materials for the class. The materials will remain available for download in your online account indefinitely from the date of purchase, unless specified otherwise.

As a student, when you enroll in a class, whether it’s a free or paid class, you are getting from Vastukul a license to view the class via the Vastukul platform and Services, and Vastukul is the licensor of record. Classes are licensed, and not sold, to you. This license does not give you any right to resell the class (or Vastukul Materials) in any manner (including by sharing account information with a purchaser or illegally downloading the class and sharing it on torrent sites).

In legal, more complete terms, Vastukul grants you (as a student) a limited, non-exclusive, non-transferable license to access and view the classes and associated content for which you have paid all required fees, solely for your personal, non- commercial, educational purposes through the Services, in accordance with these Terms and any conditions or restrictions associated with a particular classes or feature of our Services. All other uses are expressly prohibited. You may not reproduce, redistribute, transmit, assign, sell, broadcast, rent, share, lend, modify, adapt, edit, create derivative works of, sublicense, or otherwise transfer or use any class unless we give you explicit permission to do so in a written agreement signed by a Vastukul authorized representative. This also applies to content you can access via any of our APIs.

We generally give a lifetime access license to our students when they enroll in a class. However, for liability reasons we consider that the legal access expires in a year and we reserve the right to revoke any license to access and the use of classes at any point in time in the event where we decide or are obligated to disable access to a class due to legal or policy reasons, for example, if the class you enrolled in is the object of a copyright complaint, or if we determine its content violates our terms. The access is not applicable to add-on features and services associated with a class, for example translation captions of classes may be disabled by instructors at any time, and an instructor may decide at any time to no longer provide teaching assistance or Q&A services in association with a class. To be clear, the access is to the class content but not to the instructor.

Payment and Fees

Fees for courses and programs are collected by Vastukul from students via Razorpay Payments and (subject to the below) are then remitted to the teacher via PayPal Payments.

Refunds are available until fourteen (14) days after the later of (a) the enrollment date or (b) the class launch date. Assuming receipt by Vastukul of payment from a student, fees for online classes will be sent to Razorpay for processing on the first regularly scheduled “payment date” after the expiration of the refund period described above. Regularly scheduled “payment dates” are on the 16th of each month (or if any such day is not a business day, the next succeeding business day).

Payouts sent on the 16th of each month are for transactions that have occurred in the previous calendar month, beginning 14 days after your official launch date.

Teachers and students agree that Vastukul’s responsibility is solely to process payments as set forth above, and Vatsukul is not party to any transaction between any student and/or teacher and cannot be held responsible for any issues arising from any such transaction.

A full payment is required to register for a class on Vastukula, unless otherwise agreed by the teacher.

Fees for classes or any other portion of the Service may be changed at any time without prior notice.

Instructors are responsible for all income, sales and other taxes associated with fees earned from their classes. Vastukul reflects fees paid to such teachers following the end of each year, and reserves the right to withhold any payment until it has received all tax identification information it reasonably requires.

Classes Cancellations and Refunds

Except for the refund period for online classes described above, Vastukul is not responsible or liable for any refunds for classes.

Students whose classes are cancelled after enrollment, but before the launch date, will receive a full refund of the price paid.
